A large airplane with 20 or more seats or 6000 pounds or more of payload
being used in private or non-common operations must be operated under
Part 125, unless a deviation is obtained from the FAA to operate the airplane
solely under Part 91 General Operating Flight Rules.
The Part 125 certificate is becoming more and more popular with the advent
of large, personal-use aircraft.
Part 125 allows what we call contractually shared use. The aircraft owner
may contract with other companies to provide transportation for their
own use, however strict controls limit the commercial use of the airplane.
